Nearly two years after filing a lawsuit against Family Dollar Stores of Texas, Mary Jane Walters (plaintiff) has now filed a notice of dismissal with prejudice to dismiss all claims against Family Dollar.
Walters filed the lawsuit on Jan. 12, 2011 in Jefferson County District Court claiming “picture frames and other items,” fell on her, causing her to twist her knees and right ankle while shopping at the Family Dollar on 11th Street in Beaumont on Sept. 11, 2009.
After the incident, Walters claims an employee did not offer assistance and instead told her, “she was luck that she didn’t get hit by the big mirror back there [because] merchandise was always falling from that area of the store.”
Walters alleged the store did not accurately inspect and maintain its premises, and failed to warn shoppers of the potential danger. The plaintiff was suing Family Dollar for her alleged past and future medical expense, lost wages, mental pain and suffering, and disfigurement.
The recent actions to dismiss claims against Family Dollar came after Judge Bob Wortham failed to issue a ruling at a June 18 hearing where Walters requested the court to force Family Dollar to release all information about the “hiring, findings, and dealings” of the investigator who took video surveillance of the plaintiff.
