A child injury lawsuit over the fall of a two-year-old boy at a hotel has been settled for 10.9 million, reports WAVY.com.

According to court records, Chelsye Clayton sued the owner of the Ramada hotel in Norfolk, VA, Pride Group LLC, after her son, Elijah Clayton, crawled through a railing on the walkway on the second floor that was missing a spindle, and fell onto the below. Elijah suffered permanent brain damage in the Sept. 4, 2011 incident, just a few days short of his third birthday.

Attorney’s fees and medical bills will take about $3.9 million from the settlement winnings, with the rest being paid out to Elijah through a trust and a payment plan.

The lawsuit originally asked for $50 million in damages. A judge in Norfolk Circuit Court approved the settlement in April.
