Johnson & Johnson has decided to settle thousands of lawsuits over the recall of its defective hip replacements, paying out greater than $4 billion, reports the Chicago Tribune.
The settlement will put to rest over 7,500 lawsuits against Johnson & Johnson’s DePuy orthopedics department in both federal and state courts across the country. According to a report, the settlement affects patients who have already had the defective products removed.
DePuy ASR hip systems were recalled after they had higher-than-expected failure rates. Patients reported that the metal-on-metal product caused discomfort, pain, and some serious complications that included high levels of metal ions in the blood stream.
On the market in the U.S. beginning in 2005, DePuy issued the recall in 2010 after selling about 93,000 units around the world. Statistics from the United Kingdom in 2010 show that about 12% of the hip implants needed to be replaced after a period of five years.
The U.S. Food and Drug Administration warns against all-metal implants, like those of the DePuy hip systems, as they can shed metallic fragments, which can go on to damage bone and soft tissue.
